What it means to you as
an employee
If you are an employee,
you have the duty as an
employee under the
section 15 of the WSH
Act to use personal
protective equipment
provided and cooperate
with your employer or
principal. If you willfully
or recklessly do any act
which endangers the
safety or health of
yourself or others, you
shall be guilty of an
offence.
Under the WSH Act,
employee shall
• use PPE and other
safety means provided
• co-operate with
employers in respect
to safety and health
• not to endanger the
safety and health of
himself and others.

PENALTY
Failure to cooperate or use PPE as intended - $1000
Negligent act which endangers himself or others -$30,000 and/or 24
months jail
Wilful or reckless act which endangers himself or others -$200,000
and/or 24 months jail
