City Knew of TND Traffic Concerns
City Zoning Expert’s Email to Mayor Shelton Cited Negative Traffic Impact on City

A November public records request has revealed an April 24, 2015,
email (see image at right) in which Central’s zoning attorney Mark Balkin
advised Mayor Junior Shelton that the traffic generated by the proposed Shoe
Creek TND was “not going to serve the people living in the development
or the traffic already on Sullivan” and suggested that “before final plan
approval is granted for any part of the development” the Council should
resolve the extension of Wax Road to Hooper Road. Instead, Central’s City
Council eventually approved the TND with entrances routing all traffic onto
Sullivan Road.
In the email, Balkin, whom Mayor Shelton and city council

members refer to as the City of Central’s “expert” in zoning matters, tells
Mayor Shelton and Planning and Zoning Director Woodrow Muhammad:
“It doesn’t require a traffic engineer to know that one entrance onto
Sullivan and one to Sagebrush is not adequate. Similarly, sending virtually
all traffic to Sullivan (whether directly or from Wax Rd. a few hundred
yards away) is not going to serve the people living in the development or
the traffic already on Sullivan.”

In their recommendation to the council, the planning commission
staff does not mention the email and zoning attorney Mark Balkin’s expert
opinion that if the TND’s only entrances routed traffic onto Sullivan
Road and through Morgan Place subdivision, the added traffic would be a
problem. As approved by the council, the Morgan Place entrance has been
eliminated, and the TND’s only entrances will empty onto Sullivan Road.

Balkin’s email was obtained as part of a public records request
initiated on November 9. After the city had failed to respond to the public There is no indication that city council members were made aware of this
records request for over a month, a public records lawsuit was heard and email and important opinion from the city’s own expert prior to their vote to
Judge Don Johnson instructed the city to release the documents. The approve the TND.
documents, including Balkin’s email, were finally released in late December.

Answer Raises Questions

Why Public Records Access Matters


After reading the email
(see page 1) from Central’s expert
planning and zoning attorney
Mark Balkin to Mayor Shelton,
I’m wondering how anyone
involved in the approval of the
Shoe Creek TND, with 10,000
square feet of commercial space,
447 houses, and 250 apartments,
could read that email and still
support the project as proposed.
There certainly must be a better
explanation.

In a nutshell, way back
in April, Central’s attorney
and zoning expert Mr. Balkin
indicated that the additional traffic

of the Shoe Creek TND posed
a problem. Balkin stated that
the development would require
more than a couple of entrances
onto Sullivan Road and the one
through Morgan Place (which
the council has since prohibited).
His email calls for an extension
of Wax Road to Hooper Road to
handle the TND traffic. However,
the project was approved with the
only entrances leading to a short
stretch of Sullivan Road.

I won’t tell you I know
everything
else
that
may
have factored into apparently
disregarding the advice of the
city’s own zoning expert.
I
do know that Balkin’s email
was sent to Mayor Shelton and
Planning and Zoning Director
Woodrow Muhammad. I don’t
know whether it was ever shared
with the Central’s city council
members.

I also must confess that
our elected officials and I are not

real chummy lately, so until better
explanations surface I’m left with
these questions:

Why would the city
council vote to prevent traffic
through Sagebrush Avenue if
they knew of Mr. Balkin’s email
advising that Central’s streets
could not effectively handle the
traffic of this TND even WITH
the Sagebrush connection?

Why
did
Central’s
Planning and Zoning Director
Woodrow Muhammad, at Mayor
Shelton’s request, ask EBR
traffic engineers to approve
the Shoe Creek traffic study,
telling them that the Sagebrush
Avenue connection “has not
been eliminated,” after receiving
Balkin’s email which all but
mandated a direct connection to
Hooper Road?

Had Central’s city council
members even seen this email
when they voted to approve the
TND in the face of overwhelming
public opposition to the project?

How could any public
official have such an important
public record in their possession,
in the face of so many questions
by citizens, on the largest
development in the history
of the city, and not share that
information with the people of
Central until forced to do so by a
court decision?

What did Central’s zoning
expert think of the traffic impact
of the proposed TND? I believe
the email makes that clear, but
the answer raises more questions.
Answers to these questions would
be Good News for a Great City.

This newly-discovered opinion
re-opens questions about the
approval of the traffic impact study
used by the city to support approval
of the Shoe Creek development.
For any development to proceed,
its traffic impact study must be
approved by East Baton Rouge
Traffic Engineering, as well as the
Central City Council. There is no
evidence that either of these groups
were made aware of Balkin’s expert
opinions expressed in his email to
Mayor Shelton.

On July 20, 2015, EBR Traffic
Engineering declared the traffic
impact study for the Shoe Creek
TND “invalid,” in part because the
Sagebrush Avenue traffic connection
to Morgan Place subdivision had
been eliminated by the Central City
Council, leaving only the entrances

on Sullivan. Central’s Planning
and Zoning Director, Woodrow
Muhammad, testified in October that
he sent an email response later that
same day, at the direction of Mayor
Shelton, assuring that the connection
to Sagebrush Avenue “has not been
eliminated.” In fact, the Central City
Council voted on May 26, 2015,
not to allow the dedication of the
Sagebrush Avenue connection as a
public street.

The
council
ordinance
instead left the street private, allowing
bollards to be placed on the street
to limit it to foot traffic. However,
as a direct result of assurances by
the City of Central, EBR Engineers
withdrew their objection to the use
of the traffic impact study, clearing
the way for the council’s approval of
the Shoe Creek TND.

When my wife and I moved from
the Midwest to Central 3 ½ years ago,
we noticed something when we drove
around Central at night – it was dark;
it was very dark! Only around the
major retail and restaurant areas was
it not dark. We were used to being
able to see the road well as we traveled
throughout the Midwest. We have
had to adjust to the lack of light as we
drive around Central at night. We are
making progress! Light for our eyes is
a good thing!
In the Bible we read about the
importance of light – the light that
shines from God’s Word so that we
might know God better, know what
we are to believe about Him, and
how we are to live to honor Him. In
Psalm 119:105, we read, “Your Word
is a lamp to my feet and a light to my
path.” God’s Word (the Bible) is what
we need every day, no matter if it’s
dark out or not, so that we can come

to know and love the Lord more and
more. God’s Word also points us to
Jesus Christ over and over again –
what He has done to accomplish our
salvation, how He meets our spiritual
needs and transforms our lives with
the grace of forgiveness. God’s Word
is clear that we desperately need Jesus
Christ and His righteousness 24 hours
a day, 7 days a week.
We have the greatest source of light
as we live each day – God’s Word.
God’s Word is the light we need each
day to grow in our love and knowledge
of the Lord Jesus Christ. Why not make
2016 a year in which you take God’s
light and use it each day (reading and
studying it), so that when you stumble
you will know the way back to the path
of God – keeping your eyes on Jesus –
the Light of the world!

responded
to
a
warehouse
fire Wednesday
morning in the
13800 block of
Florida
Blvd.
When firefighters
arrived on scene,
they discovered
heavy fire in one
end of the long
warehouse.
As
firefighters began
to attack the fire,
it was obvious more personnel would be needed and a second alarm was
requested, bringing in engines from the District Six and the Baton Rouge
Fire Departments.

An aggressive attack prevented the 8:59 a.m. blaze from spreading
past the area of origin, but not before causing approximately $160,000 in
damage to the structure and contents. Approximately 84 small motorcycles
were destroyed in the fire. There were no civilian or fire service injuries.

There will be a MANDATORY parent meeting for all returning
CHS football players and all football players who recently
signed up. The meeting will be held on Thursday, January 28 at
6:00 p.m. in the Central High School cafeteria. It is important
that each football player have at least one parent attend.

BATON ROUGE, LA –
Attorney General Jeff Landry is
warning Louisiana residents and
businesses to be vigilant of telephone
scammers claiming to be associated
with the Internal Revenue Service
(IRS). Recently, Attorney General
Jeff Landry’s Consumer Protection
Section has received calls from
people reporting that they have been
contacted by scammers identifying
themselves as IRS representatives.

Victims are told they owe
money to the IRS, and it must be paid
promptly through a pre-loaded debit
card or wire transfer. If the victim
refuses to cooperate, they are then
threatened with arrest or suspension
of business and driver’s licenses.
In many cases, the caller becomes
hostile and insulting.
“These
scammers
are
shameless criminals who will stop at
nothing to get your cash or personal
information,” said Attorney General
Jeff Landry. “If you receive a call
from someone claiming to be a

representative from the IRS who
is threatening to take legal action
against you, remember that the IRS
does not initiate contact requesting
information by electronic means.
Also, they do not call asking for credit
card numbers or demanding payment
without first sending a notification by
mail.”

If you get a phone call from
someone claiming to be from the
IRS: If you know you owe taxes
or you think you might owe taxes,
call the IRS at 800-829-1040. The
IRS employees at that line can help
you with a payment issue – if there
really is such an issue. If you know
you do not owe taxes or have no
reason to think that you owe any
taxes, call to report the incident to the
Treasury Inspector General for Tax
Administration at 800-366-4484.
