GENERAL GUIDELINES AND REGULATIONS
By signing this event Vendor Agreement, participants agree to be bound by the following terms and conditions:
1. Vendor space shall be allocated by Vendor manager. Food Vendor menus will require approval sufficiently in advance of
the event so that duplications are avoided. FOOD AND GOODS MAY BE SOLD AT THIS EVENT. No vendor is to sell or distribute
alcoholic beverages of any sort.
2. All Vendors are required to be OPEN FOR BUSINESS BY 2PM AND REMAIN SO UNTIL THE CLOSING OF THE EVENT AT
9PM. All booths must be staffed during these hours. Vendors cannot cease operations prior to the close of the Festival for any
reason without the express, written consent of the Chair of RFAC’s Executive Committee, Shauna Malgieri.
3. Booths must be occupied by a single business only. Vendors may not share booth space.
4. The Vendor must NOT use more than their allotted space. Vendors found using more than their allotted space will pay the
cost of an extra booth. Vendors are prohibited from engaging in sales outside of the booth to which they have been assigned.
Vendors are further prohibited from attracting patrons by standing outside their designated space, using horns or any other
similar means to capture the attention of the public.
5. S-One and Del Couch Music Education Foundation are the sole Vendor of alcoholic beverages. No Vendor may sell any
alcoholic items. Sale of these beverages could result in immediate expulsion from the Event.
6. All Vendors and their employees are expected to monitor themselves on all matters of conduct and attire. Any Vendor or
employee not acting in good faith, showing dignity and respect to all business and individuals may be asked to depart the
Event without a refund.
7. Food Vendor must comply with all health department guidelines. S-One / Del Couch Music Education Foundation will not
be supplying wash sinks.
8. Vendors MUST remove ALL trash in their area upon the closing of the Event. Vendors will bring their own trash bags and be
responsible for taking their garbage with them.
9. It is the Vendor’s responsibility to pay the appropriate TAXES AND FEES to the State of Florida. S-One / Del Couch Music
Education Foundation is required to submit a list of participating Vendors to the State of Florida Department of Revenue.
Proof of such may be required. S-One / Del Couch Music Education Foundation assumes no responsibility whatsoever for
collecting or remitting taxes and/or fees of any kind that may be due from any Vendor.
10. Vendors will not be entitled to refunds or to cancel their participation. NO EXCEPTIONS.
11. RFAC’s Chair and their designated representative will make periodic inspections of booth space. Any items for sale which
are prohibited may be removed from the booth space and will not be allowed to be sold for the duration of the event.
HOLD HARMLESS AGREEMENT:
Vendor releases and holds harmless the City of Sarasota, the sponsors of the event, business owners, manager, merchants,
associations, and their agents, servants and employees, S-One Holdings Corporation / Del Couch Music Education Foundation,
its agents, servants and employees from any and all responsibility, personal liability, loss or damage resulting from theft, fire,
loss of life, personal injury and/or damage to property that may arise or occur to the Vendor, his agents, servants and employees, associates, goods, property or the public, and from any conditions whatsoever that may occur while the premises are in
use, during setup, the Event hours or when closed after the Event. We reserve the right to remove Vendors and their exhibits if
the terms and conditions above are not complied with and whose conduct is not acceptable.
Misrepresentation of the part of the exhibitor in any form will result in cancellation of space and total loss of fee. Entry into the
Event premises constitutes an acknowledgment that the Vendor and his representative shall abide by the terms set forth
herein. This is a non-cancelable and non-refundable, rain or shine event.
