EXISTING SERVICE CONDITIONS
(1) 70% of the posts L.D.As are directly recruited through P.S.C.
30% of the posts are filled up by eligible Group-Ds of
Secretariat on promotion (10%), conversion of Typists (B.G.)
borne in the Sectt. Common Cadre (10%) and transfer of
Directorate L.D.C.s (10%).
(2) L.D.A. seniority determines the seniority position in the U.D.A.
Gradation list. Seniority in the U.D.A. Gradation list
determines the seniority in the H.A. Gradation list and
seniority in the H.A. Gradation List determines the seniority in
the post of Section Officer. Promotion to the post of O.S.D. /
Registrar / Special officer in the West Bengal Secretariat
Service is based on seniority of Secretariat Assistants in the
U.D.A. Gradation List.

Cadre specific Issues of Secretariat Assistants
1. The issue of restoration of pay-scale of Sectt. Assistants against the
backdrop of historic pay cut of L.D.A.s and U.D.A.s in the first pay
commission which came into effect from 1.4.70 ( ROPA 70) and H.A.s and
S.Os in the second pay commission which came into effect from 1.4.81
(ROPA-81) has always been a debated issue. After our organisation started
operating from 1995 the issue came before the Sectt. Employees in the
form of a demand. But the demand for restoration of pay was not an end in
itself. It was correlated with betterment of service conditions of the
Secretariat Assistants with the ultimate objective of improving the delivery
mechanism in the Secretariat in particular and of the Govt. as a whole.
2. The first Pay Commission did not pay heed to the fact that the Sectt.
L.D.A.s and U.D.A.s had all along enjoyed a better pay scale than clerical
posts in directorates and other subordinate offices in districts. In the name
of rationalisation of pay scales and on the pretext of constitutional
guarantee of equal pay for equal work, which lacked objectivity neither
from the point of administrative functioning, nor from the point of job
evaluation in this particular case, the Sectt. Assistants were handed with a
retrograde pay scale at par with the clerical posts of all offices of the Govt.
of West Bengal. This is evident from the strong note of dissent given by the
chairman of first Pay Commission K.K Hazra in favour of a better pay scale
for clerical posts of Sectt.. Although his viewpoint was overridden as a
minority view at that time ,we hope that the present Commission would
consider his views in the matter of wage determination of Sectt. Assistants.
3. Whereas the first Pay Commission handed over a retrograde pay scale to
the Secretariat L.D.A.s and U.D.A.s the Second Pay Commission
downgraded the pay scale of Sectt. H.A.s and S.O.s in real terms. However
, even after the down-gradation of pay scales, the Sectt. H.A.s enjoyed a
higher initial start which was higher than the entry pay of WB.C.S(Exe).
Officers. If we look at the wage pattern of Sectt. Assistants as have been
revised in the subsequent Pay Commissions we will see a downward curve
in respect of status as have been previously enjoyed by them.
4. This Association gave a detailed memorandum to the fourth pay
commission and fifth pay commission on the issues of up-gradation of pay
scales of Sectt. Assistants, restructuring of the cadre by constitution of Jr.
Sectt. Service and Senior Sectt. Service as well as re-designation of the
posts with upgraded service conditions. The Pay Commissions while
acknowledging the demands made by this Association and that of the
physical pay cut of the Sectt. Assistants in the first Pay Commission chose
not to disturb the hitherto established pay parity of Sectt. Assistants and
Clerks of other offices and did not recommend any up-gradation. The
history of injustice meted out to the Sectt. Assistants thus remained
unaddressed in these pay Commissions. The dissent of the Sectt.

Assistants were re-invigorated when they noticed that the fifth Pay
Commission had actually recommended lateral entry to the posts of H.A.s
and S.O.s in Sectt. from other cadres and made some caustic comments
about their efficiency in place of upgrading their position on the basis of
their job evaluation.
5. In 2001 when the Govt. constituted West Bengal Sectt. Service, the
feeder service in the form of West Bengal Junior Sectt. Service was
not constituted. This Association gave a representation to the then Chief
Secretary and PAR Secretary. The Govt. at that time committed that Sectt.
Assistants would be included in the Sectt. Service and that their stake in
the Sectt. hierarchy would remain unchanged. However that commitment
was not kept. While this Association had been pressing for a separate
recruitment rules for entry to Junior Sectt. Service with upgraded service
conditions, the Govt. came out with a uniform recruitment rule vide 7165F(P) dt. 01.07.2010 for Sectt. Assistants and Clerks of other offices in
supersession of 1954 rules for entry to Sectt. and certain other offices
wherein the supremacy of Sectt. Assistants in terms of pay and status were
clearly defined.
6. Over the last few years administrative machinery in the Sectt. has gone
through a process of complete overhauling. E-governance initiatives have
geared up. Budgetary allotment, fund management and fund mobilisation
have come under the purview of e-governance. This Association have time
and again written to the Govt. to accommodate the Sectt. Assistants in the
process of e-governance. Hon'ble Finance Minister in his initial
deliberations to Sectt. Assistants and officers had requested to inculcate a
sense of ownership in the functioning of the system. That was a welcome
call. Each department has now a well defined Audit Budget set-up and a
D.D.O set-up running on latest e-governance modules. With the core
departments like C.M.O, Home, PAR and Finance dealing with core policy
issues, the engineering departments and the social sector departments
deal with policies relating to infrastructure and public delivery
mechanisms. West Bengal Sectt. is now the frontrunner in the country in
e-governance initiatives, thanks to the pragmatism of the Govt. The Sectt.
Assistants and the officers in the West Bengal Sectt. Service promoted from
the Sectt. Assistants are key players in this machinery. They have taken
painstaking efforts to upgrade and accommodate themselves in the present
machinery.
7. It is unfortunate to note that while other states have decided to upgrade
the service conditions and pay structure of Sectt. Assistants the Sectt.
Assistants in West Bengal Sectt. are lagging far behind. Section officers in
Central Sectt. have achieved pre-revised scale no. 16. Assistants in Central
Secretariat are also enjoying higher pay than their counterparts in other
Central Govt. Offices. They have been re-designated as Assistant Section
Officer. U.D.C.S in Central Secretariat have been given a higher grade pay

in the form of selection grade than their counterparts in other central govt.
Offices and they have been redesignated as Sr. Secretariat Assistant.
L.D.CS have been re-designated as Jr. Sectt. Assistant.
8. Of late the West Bengal Govt. has constituted a high power committee with
the approval of Hon'ble C.M. to look after the issues of constitution of Jr.
Sectt. Service, separate recruitment rules for entry to this service and
restoration of pre-70 pay-scale for the assistants. These all are welcome
steps. However the primary focus of the committee appears to be
direct recruitment to the West Bengal Secretariat Service from prerevised scale no. 16 to 19, in which the Secretariat Assistants are the
only stakeholders.
9. This Association being dedicated to the issues of service conditions of
Sectt. Assistants and campaigning for the upgraded service conditions of
the Sectt. Assistants from the perspective of better delivery mechanism of
the Sectt. cannot accept such a move of the Govt. This Association hopes
that the Hon'ble Commission will appreciate the concern of this
Association as a cadre Association with professional commitment in the
Sectt. functioning. The Govt. while appreciating the role of Sectt. Assistants
in one hand by allowing Jr. Sectt. Service and higher pay with upgraded
service conditions in the basic posts cannot take away with other hand the
promotional posts which is a recognition of their functioning in the
Secretariat till date. While individual promotion cannot be a vested right,
the stake of the Assistants in the West Bengal Secretariat Service is a
matter of accrued status and right. Hon’ble Supreme Court has hold the
position that although the service conditions of an employee can change at
some point of time, the accrued status and right cannot be infringed upon.
While, we are in favour of change in service conditions in an upgraded
manner in consonance with the changing times, we cannot agree to direct
entry or lateral entry at any level either in the Sectt. Common cadre or
West Bengal Secretariat Service which will be a total jeopardy of our
accrued status and right. It may be mentioned that the Secretariat
Common Cadre is an un-constituted service and we are proposing
West Bengal Junior Secretariat Service as the feeder service of West
Bengal Secretariat Service. The expertise gained in the Sectt.
Functioning by Sectt. Assistant for long years help him to play a well
deserved role in the mid-level bureaucracy as we have seen for years,
which is utterly helpful to the Government.
So direct
recruitment/lateral entry should not be allowed in W.B.S.S. other than
promotion from W.B.J.S.S.
On the basis of above discussions we now propose our cadre structure in
the following manner
