Upon consideration of FMC Butner’s reports, as supplemented by Dr. Stribling Riley, Dr. Pennuto,
and Dr. Herbel’s testimonies, the Court finds that Defendant is competent to proceed to trial.

Defense counsel advised the Court that Defendant desires to waive his right to a detention hearing,
subject to reopening.
