FinalversionoftheRSPCAsresponsetotheWoolerreview (3) 100%

The  primary purpose of the review was to assess prosecution decisions (both  positive  and  negative)  and  subsequent  conduct  of  any  proceedings  so  as  to  determine  how  far  these  accord  with  the  standards  of  a  reasonable,  competent  and  objective  prosecutor.  It  is  important  to   stress   the  review  concludes   that  the  Prosecutions  Department  performs  well   in  terms  of  its  case  outcomes;  that  the  RSPCA  enjoys  good  standing  before  the  courts  for  the  effective  manner  in  which  its  cases  are  presented;  that  its  staff  are  well  motivated,  conscientious  and  highly  committed;  that  underlying  RSPCA  performance  in  terms  of  prosecution  outcomes  is  at  least  as  good  as  the  CPS  and probably three or four percentage points better; that there is no other  body   which  could  take  on  the  RSPCA’s  current  role  which  is  too  valuable  to  be  lost  and that the management of prosecutions conducted by the RSPCA is  clearly  more   effective  and  thorough  than  found  in  most   other  prosecuting  authorities  including  the  CPS.  With  regard  to  the  application  of  the  Code  for  Crown  Prosecutors,   the  file  sample  tested  in  the  review  showed  that  the  assessment  of   the  evidence  was  largely  satisfactory.  Whilst  acknowledging  that  the  application  of  the  public  interest  test   to  animal  welfare  cases  can  often  be  difficult,  the  review  considered  the  proportion  of  cases  where  consideration  of  the  public  interest  test  was  flawed  was  too  high  and  the  review  makes   a  number  of  observations  that  will  help  the  RSPCA  address  this.   8.

Federal Prosecution 90%

HENNING* INTRODUCTION S ince the 1970s, federal prosecutors have been particularly active in prosecuting state and local officials for corruption, even when the misconduct does not directly affect the federal government.

TP Statement Extract 89%

I would stress that this selective prosecution issue is also intrinsically linked to that of the staggering inconsistency in terms of the sentencing of abuse offenders – or of not even prosecuting them at all..

The intensity with which your agencies have pursued this case also begs the question of whether limited federal resources were wisely used, since it does not seem to rise to the level of many of the crimes of vital importance to national security and safety that you are charged with investigating and prosecuting.

Stout v. State (Ark. 1968) 88%

The Supreme Court, Brown, J., held that refusal, in homicide prosecution, to require, on defendant's motion, prosecuting attorney to produce defendant's written statement, made shortly after defendant shot and killed deceased, for purpose of determining whether any inconsistency existed between such statement and defendant's testimony as prosecutor claimed, was reversible error.
