Brownfields are “real property, the expansion, redevelopment, or reuse of which may be complicated by the presence of a hazardous substance, pollutant, or contaminant.”4 Cleanup and reuse of brownfields “protects the environment, reduces blight, and takes development pressure off greenspaces and working lands.”5 Residential property values can increase between 5-12.8 percent after brownfields cleanup.6 Additionally, many brownfields are located within existing infrastructure, promoting urban revitalization in a cost-effective manner.7 Brownfield cleanup and redevelopment contributes to job growth and an increased tax base, combats crime, and reduces pollution.8 It is estimated that there are more than 450,000 brownfield sites in the United States.9 In 2002, the Small Business Liability Relief and Brownfields Revitalization Act (the “Brownfield Amendments”) was enacted.
