01Purpose

These terms of use govern access to and use of the PDF Archive service, available at pdf-archive.com. Creating an account implies their full and unreserved acceptance. The terms that govern the sale of the Pro plan are set out in the PDF Archive Pro Terms of Sale.

03Description of the service

PDF Archive is a service for hosting, archiving, organizing and sharing documents, mainly in PDF format, reachable through a web interface and through an API (REST, MCP, S3). It covers the upload and the filing of documents, dated public shares, encryption, a PDF toolbox and QR codes.

The service is offered under two plans: Free, which requires no payment card, and Pro, both detailed on the PDF Archive Pro page. Larger scale needs are covered by a managed dedicated instance, quoted on request.

Files received from a third party. Each account has a drop address that lets a person without an account send it a document. The document arrives in an inbox that is separate from the archive. A document that is not filed into the recipient's archive is deleted from it at the latest twelve months after it was sent, sooner if the recipient has chosen a shorter retention period, together with the address and the message that the sender may have left. The recipient is warned by email before the deadline, which is also announced to the sender at the time of sending. Once filed into the archive, the document no longer has a deadline and follows the same rules as the other documents of the account.

04Registration and account

Registration is open to any individual or legal entity aged 16 or over, who undertakes to provide accurate information and to keep it up to date. Each account is personal. The user is responsible for the confidentiality of their credentials and for any activity carried out from their account. Two-factor authentication is recommended.

05Acceptable use

The user undertakes to comply with the applicable law and with these terms. The following are prohibited in particular:

Uploading or sharing unlawful content: hate speech, counterfeiting, invasion of privacy, child sexual abuse material, or any content that is manifestly unlawful within the meaning of the law.
Uploading content for which the user does not hold the rights, or infringing the rights of third parties.
Any use intended to place an abnormal load on the infrastructure: flooding, circumvention of quotas, mass scanning.
Using the service to distribute malicious software or to circumvent security measures.
Reselling the service or making it available to third parties outside the intended framework.

Health data excluded. The service is not approved for the hosting of personal health data. The user undertakes not to upload or process health data subject to the French "Hébergeur de Données de Santé" approval or certification (HDS, article L1111-8 of the French public health code), nor any sensitive data requiring a specific compliance framework. This prohibition applies to every plan, including managed dedicated instances.

Temporary technical measures. In order to preserve the availability, the integrity and the security of the service for all of its users, PDF Archive may apply temporary technical restrictions or limits: capping the number of requests or the bandwidth, capping a volume, queuing or suspending an automatic processing task, blocking an IP address. These measures are proportionate to the situation, limited to what it requires, and lifted as soon as its cause has gone. They may be taken without notice where urgency demands it, in particular in the event of an attack, an abnormal load or unauthorized automated use. They constitute neither a sanction nor a termination. A user may ask for a measure that affects them to be reviewed through the contact page.

Failure to comply with these rules leads to the immediate suspension of the account, without notice and without refund in the event of serious abuse. PDF Archive reserves the right to suspend or terminate an account in the event of a use contrary to these terms or to the law, or upon a report of manifestly unlawful content.

06Liability

PDF Archive provides the service "as is" and is bound by an obligation of means. The publisher endeavours to ensure the continuity of the service without guaranteeing 100 % availability, and cannot be held liable for interruptions caused by external factors such as the host, the network or force majeure.

Backups and the copies kept by the user. PDF Archive stores uploaded documents redundantly and takes regular backups of its infrastructure. The purpose of those backups is the restoration of the service. They do not constitute an archiving service with evidential value, and they do not relieve the user of the need to keep their own copies of the documents of which they hold no other version. The user may at any time export their data and download their documents from their account, folder by folder or as a whole. It is for the user to do so before deleting their account, since that deletion is immediate and irreversible.

In respect of the hosting of the content uploaded and published by its users, PDF Archive falls under the liability regime for hosting providers laid down in article 6 of French law no. 2004-575 of 21 June 2004 (LCEN). On that basis, PDF Archive keeps the data identifying the author of a piece of content put online (article 6-II of the LCEN, decree no. 2021-1362 of 20 October 2021) for the period required by law, and discloses it upon requisition from a duly authorized authority. Editorial responsibility for a piece of content lies with its author. Any report of manifestly unlawful content may be sent through the contact page.

07Personal data

The processing of personal data is described in the privacy policy, which complies with European Regulation 2016/679 (GDPR).

08Changes to these terms

PDF Archive reserves the right to amend these terms at any time. Users are informed by any appropriate means: a notice displayed in their account, an electronic message, or the publication of the amendment on this page, which carries its version date. Continuing to use the service after that information has been given constitutes acceptance of the new terms.

09Termination

The user may delete their account at any time from their preferences. The deletion is immediate and irreversible. For Pro subscribers, the cancellation of the subscription is separate from the deletion of the account and is carried out from the billing portal.

10Governing law

These terms are governed by French law. Any dispute will be brought before the competent courts in France.
