1. This Promotional Competition –“ Pay to Win R50k” - (“Competition”) is organised and run by
Zapper Marketing SA (Pty) Limited (“Zapper”) and its nominated agents (collectively,
“Promoters”). The Competition is open for entry by all South African residents of 18 years
and older with a valid South African identity book, except employees of the Promoters and
its advertising and/or promotion agencies, and/or merchants that form part of the
Competition and their immediate families. Participants in the Competition agree that Zapper
may contact them in connection with future competition or promotions.
2. By entering this Competition, all participants agree to be bound by these terms and
conditions, which will be interpreted by the Promoters and the Promoters’ decision regarding
any issue with the Competition will be final and binding and no correspondence will be
entered into.
3. This is a transaction-based Competition. Entries may only be submitted via a payment via
the Zapper mobile application. The use of false information on the Zapper app will disqualify
such user from participating in the Competition.
4. No responsibility will be accepted for any entry that is not delivered, received or is delayed
due to technical reasons or otherwise.
5. To enter and participate in this Competition, all participants are required to:
5.1. scan the Competition QR code with Zapper once (the QR code can be found online on
Zapper’s Facebook, Twitter and Instagram feeds);
5.2. Use the Zapper mobile app to purchase from any Zapper merchant (each such
transaction via Zapper is an entry into the Competition);
5.3. monthly competition PLUS the main competition where the user will stand a chance to
win R50 000 to spend at Zapper merchants via the app.
6. The Competition will run for a limited period, from 4 August 2016 to 15 January 2017, and
after the closing date Zapper transactions will not be considered as entries to the
Competition.
7. Prizes
7.1. There will be a monthly prize awarded during the period of the Competition and 3 ‘main’
prizes to be awarded after the closing date. The prizes are as follows:
7.1.1. Each monthly prize will consist of a merchant or Zapper voucher of variable
value, to be redeemed by the winners at Zapper merchants in the restaurant
industry;

7.1.2. Each of the three main prizes will consist of fifty Zapper vouchers to the value of
R1000.00 per voucher (total prize value of R50 000.00), to be redeemed by the
winners at Zapper merchants in the restaurant industry, at the rate of one
voucher per week and per restaurant visit.
7.2. Each Zapper transaction during the Competition will be an entry into the Competition,
and therefore participants may enter multiple times.
7.3. A winner of a monthly prize can only win one monthly prize during the Competition, but
will still be eligible to win one of the main prizes at the end of the Competition.
7.4. The prizes do not cover any other costs of the winners whatsoever.
7.5. The Prizes will not be transferable or negotiable, and no requests for cash or other
alternatives will be considered.
7.6. The Promoters reserve the right to substitute a prize for an alternative prize of equal or
greater value should any prizes not be available due to unforeseen circumstances.
8. The winners will be selected by a random system-generated-draw and the draw will be
overseen by an independent person in terms of the Consumer Protection Act.
9. The draw for monthly prizes will take place on the last day of each month during the period
of the Competition, and the draw for the main prizes will take place on 27 January 2017.
10. The prize winners will be contacted via their contact details submitted on the Zapper app,
within one week of a draw having taken place.
11. In the event that a winner is ineligible to accept a prize in terms of the Competition rules as
set out above, or is unable to accept a prize for any reason whatsoever, a replacement
winner will be drawn from the remaining qualifying participants in accordance with the same
process as applicable to the draw.
12. The Promoters reserve the right:
12.1.

to select an alternative winner in the event that that they reasonably believe, in
their sole discretion, that the drawn winner has contravened any of these terms
and conditions; and

12.2.

to draw the winners on any alternative day should the need arise due to
unforeseen circumstances.

13. The Promotes may require a winner to provide additional information as may reasonably be
required to confirm the identity of the winner and to process and/or facilitate the winner’s
receipt or use of the prize.

14. By entering the Competition, each participant agrees that, in the event that he or she wins
one of the prizes, the Promoters may publish his or her name, surname and images,
including photographs, on Zapper’s social media accounts and/or television without any
liability to the Promoters or remuneration due to such participant, and that he or she will cooperate with any reasonable requests by Zapper relating to post-winning publicity.
15. The terms and conditions of the Competition it may be varied by reasonable notice at any
time during the period of the Competition, and such varied terms and conditions will be
effective as at such date as may be determined by the Promoters. No participants shall have
any recourse against the Promoters as a result of the variation of the terms and conditions.
16. The Promoters reserve the right to:
16.1.

extend or shorten the period of the Competition for technical reasons or due to
unforeseen circumstances beyond its control; and/ or

16.2.

terminate the Competition if required to do so by any lawful authority

and in such event participants shall have no recourse against the Promoters whatsoever.
17. No participant or winner shall have any claim whatsoever against the Promoters for loss or
damage, whether direct, indirect, consequential or otherwise, and howsoever arising from
participation in this Competition.
18. Any decisions taken by the Promoters’ in respect of the Competition shall be final and no
correspondence will be entered into.
19. The terms and conditions of the Competition shall be governed by the laws of the Republic
of South Africa.
